The moment signifies a hard-won victory for publishing, and it comes at a propitious moment for the AAP team, key members of the staff of which are in Mexico. There, the AAP is a partner to CANIEM, the Mexican publishers’ organization, in producing for this week’s International Publishers’ Association (IPA) and thus providing more than 200 publishing-delegates with whom to share the news.
Here in Guadalajara, Maria A. Pallante—AAP’s president and CEO—has spoken on behalf of AAP’s board of directors, saying, “After five years of litigation, we’re thrilled to see this important case rest with the decisive opinion of the Second Circuit, which leaves no room for arguments that ‘controlled digital lending’ is anything more than infringement, whether performed by commercial or noncommercial actors, or aimed at authorship that is creative or factual in nature.
“As the court recognized, the public interest—and the progress of art and science that is the mandate of the Constitution’s copyright clause—is served best when authors and their publisher-licensees can decide the terms on which they make their works available.
“We are indebted to Hachette, HarperCollins, Penguin Random House, Wiley, their authors, and the many amici in this case who stood up for copyright, without which we would be a less inspired and less informed society.”
The primary focus of the case was the Internet Archive’s “Open Library,” an unlicensed, global distribution platform.
After scanning millions of print books—digital files that the court easily found constituted market-substitute ebooks—the Internet Archive proceeded to “lend” the copies worldwide without any consent or payment to authors or publishers.
It sought to justify its end-run around the publishers’ markets, including their substantial ebook markets with US public libraries, by presenting a radical theory: that the Internet Archive or its partner libraries could make and distribute unlicensed digital copies if they retained a print copy of the book for each digital “borrow.”
“Moreover,” the AAP’s media messaging says today, “the Internet Archive loudly encouraged thousands of libraries to stop licensing ebooks and instead use its platform.
“The court fully grasped the slippery slope and catastrophic impact of such conduct if other actors were to adopt Internet Archive’s conduct.
The International Publishers Association, seated this week at its Guadalajara congress, is one of the organizations which had filed briefs in support of the publishers, along with multiple legal experts and creator organizations—including briefs led by the Authors Guild and former Members of Congress.
Many of these made the point that the Internet Archive cannot rewrite to its own advantage the laws that the US Congress alone has power to enact.
The amici also argued that there’s an existential danger from the Internet Archive’s efforts to assemble an unlawful digital collection in which millions of literary works and other creative content are now vulnerable to piracy, including by artificial intelligence developers.
“Unsurprisingly,” the AAP writes today, “the court concluded that the Internet Archive’s theory of ‘controlled digital lending’ lacks any legal authority; harms authors (who have the right to set the terms for each format of a work); and usurps the value of publishers’ markets in contravention of the Copyright Act.
“’If authors and creators knew that their original works could be copied and disseminated for free, there would be little motivation to produce new works,’ the Court said. ‘And a dearth of creativity would undoubtedly negatively impact the public.”
The court concluded that digitizing physical copies of written work is not “transformative” (the legal requirement), because it merely “transforms” the material object embodying the expression, not the expression itself.
“The Copyright Act protects authors’ works in whatever format they are produced,” the court said.
Nor is an infringer free to mask or nullify its infringement—for example by asserting an “owned-to-loaned” ratio of physical to digital copies—the court underscored.
A minor part of the case was the Internet Archive’s self-branded “National Emergency Library (NEL),” with which the district court dispensed in one sentence.
As the AAP puts it today, “with this case concluded, publishers have achieved a decisive and broadly applicable victory for authors’ rights and digital markets, an outcome that was our foremost, principled objective.
“In addition, the Internet Archive is bound by a sweeping permanent injunction and must make a payment to AAP, which funded the action, the amount of which is confidential under the terms of a court-approved, negotiated consent judgment between plaintiffs and Internet Archive.
“We are, however, permitted to disclose that ‘AAP’s significant attorney’s fees and costs incurred in the action since 2020’ will be ‘substantially compensated.’”
The publishers and AAP were represented in this case by the law firms of Davis Wright Tremaine and Oppenheim + Zebrak. Thes second circuit opinion is available here. AAP, in seeing its efforts on the Internet Archive case conclude today in this way is following several successfully fought censorship battles in the United States.

Austrian president tasks far-right leader with forming government – Al Jazeera English
FPO leader Herbert Kickl gets mandate to try to lead a government, which would be the first headed by the far right since World War II.
Austrian President Alexander Van der Bellen has tasked the leader of the far-right Freedom Party (FPO), Herbert Kickl, with forming a coalition government after a centrist bid to assemble one without the FPO collapsed unexpectedly over the weekend.
Monday’s announcement marks a dramatic reversal by the president, a former leader of the left-wing Greens who has long been critical of the FPO and has clashed with Kickl, but few options remained for him after the centrists failed to forge a coalition.
The eurosceptic, Russia-friendly FPO won last September’s parliamentary election with 29 percent of the vote.
It will now enter talks with its only potential partner, the conservative People’s Party (OVP), seeking to lead a government for the first time since it was founded in the 1950s under a leader who had been a senior officer in Hitler’s elite paramilitary SS.
“I have … tasked him with launching talks with the People’s Party to form a government,” Van der Bellen said in a televised address after meeting Kickl, adding: “I did not take this step lightly.”
“Kickl believes he can find viable solutions … and he wants this responsibility,” Van der Bellen said.
As the 56-year-old Kickl left his meeting with the president, hundreds of protesters, including Jewish students and left-wing activists, booed, whistled, chanted “Nazis out” and waved banners with slogans such as “We don’t want a right-wing extremist Austria”.
Van der Bellen had infuriated the FPO by not tasking it with forming a government soon after the election since no potential coalition partner was immediately forthcoming. That task fell to the OVP and its leader, Chancellor Karl Nehammer. The OVP came second in the election.
Nehammer’s attempts to assemble a three- and then two-party coalition with other centrist parties fell apart this weekend, prompting him to announce his resignation.
Analysts have said a coalition led by the far right with the conservatives as junior partners is now highly likely.
Nehammer had long insisted his party would not govern with Kickl, saying the FPO leader was a conspiracy theorist and security threat. With Nehammer gone, so is that red line.
His interim successor as OVP leader, Christian Stocker, said on Sunday his party would join coalition talks led by Kickl.
“We are at the very beginning. If we are invited to these talks, the outcome of those talks is open,” OVP heavyweight Wilfried Haslauer, the governor of Salzburg state who stood next to Stocker at his first statement to the media as designated party leader, told broadcaster ORF.
Should those talks fail, however, a snap election is likely, and opinion polls suggest support for the FPO has only grown since September.
In its election programme titled Fortress Austria, the FPO called for the “remigration of uninvited foreigners” to achieve a more “homogeneous” nation by tightly controlling borders and suspending the right to asylum via an emergency law.
It has also called for an end to sanctions against Russia. The FPO is highly critical of Western military aid to Ukraine, and wants to bow out of the European Sky Shield Initiative, a missile defence project launched by Germany.
Kickl has criticised “elites” in Brussels and called for some powers to be brought back from the European Union to Austria.
The OVP and the FPO overlap on some of these issues, particularly over taking a tough line on immigration.

Xthings announced that its Ulticam security camera brand has a new model out today: the Ulticam IQ Floodlight, an edge AI-powered home security camera.
The company also plans to showcase two additional cameras, Ulticam IQ, an outdoor spotlight camera, and Ulticam Dot, a portable, wireless security camera. All three cameras offer free cloud storage (seven days rolling) and subscription-free edge AI-powered person detection and alerts.
The AI at the edge means that it doesn’t have to go out to an internet-connected data center to tap AI computing to figure out what is in front of the camera. Rather, the processing for the AI is built into the camera itself, and that sets a new standard for value and performance in home security cameras. It can identify people, faces and vehicles.
CES 2025 attendees can experience Ulticam’s entire lineup at Pepcom’s Digital Experience event on January 6, 2025, and at the Venetian Expo, Halls A-D, booth #51732, from January 7 to January 10, 2025. The price Ulticam IQ 2K is $169 or $199 with optional 4G LTE connectivity. IQ Floodlight 2K is $199 or $239 with optional 4G LTE connectivity. IQ will be available in Q1 2025, and IQ Floodlight in Q2 2025.
Ulticam Dot, available for $69, is a portable, wireless security camera that delivers peace of mind at home or on the go. Its compact, battery-powered, and weather-resistant design makes it easy to use anywhere indoors or covered outdoors—whether at home, in a hotel room, or anywhere in between—making it a dependable and versatile security solution. Like all Ulticam cameras, it offers free cloud storage (7 days rolling) and subscription-free person and motion detection.
With 2K Quad HD video, night vision, and an ultra-wide field of view, Ulticam Dot ensures clear and comprehensive coverage, day or night. When connected to Wi-Fi, it provides real-time alerts, two-way audio, and automatic dual-layer recording. Dot also offers four customizable detection zones to deliver real-time alerts while minimizing false motion detections.
Ulticam Dot is designed for personal security wherever you need it and comes with four replaceable AA alkaline batteries, 8GB built-in storage, alarm siren, a magnetic base for mounting on metal surfaces, and peel-and-stick adhesive and screws for easy installation on any surface. Dot can stay in standby mode for up to nine months on lithium batteries. In use battery life will depend on camera activity and environment.
Built-in Wi-Fi enables direct connection to your home network without additional hubs, and the U home app allows seamless control. Dot will support integration with Amazon Alexa and Google Home at launch. It will be available starting in Q1 2025.

Xthings also showed off its smart lock brand, Ultraloq, with two new smart locks at CES. The locks include the Ultraloq Bolt Mission UWB + NFC Smart Deadbolt, the world’s first lock with ultra-wideband (UWB) technology, and Ultraloq Bolt Fingerprint Matter, one of the first Matter-compatible locks to support several smart home platforms.
Bolt Mission UWB + NFC ($399) updates the smart door lock with a precise, hands-free auto-unlocking experience. Using ultra-wideband (UWB) technology, the same technology commonly used in digital car keys, Bolt Mission senses the keyholder’s phone location with centimeter-level accuracy, determining both distance and direction of approach. This spatial awareness enables automatic unlocking as users approach from the outside and also prevents unintended unlocking when users are inside their homes.
For added convenience, Bolt Mission also features NFC for quick tap-to-unlock functionality and automatic locking. It supports Matter for easy integration, voice commands with Siri, Amazon Alexa, Google Assistant, and Samsung SmartThings, and connects directly to your home Wi-Fi via the U home App, eliminating the need for additional hubs.
Bolt Mission offers lightning-fast unlocking in under half a second.
The new version of Ultraloq Bolt Fingerprint ($199) is Ultraloq’s first deadbolt to support Matter, which enables control and management through Matter-certified apps and platforms. Digital keys can be shared with guests and family members for scheduled access using your preferred Matter-certified app.

We are delighted to announce that Just Security is establishing an Artificial Intelligence and Emerging Technologies (AIET) Initiative focused on the challenges and opportunities presented by transformative technologies. Brianna Rosen, Senior Fellow at Just Security, will serve as the inaugural director.
The AIET Initiative aims to provide rigorous analysis on the impact of rapidly advancing technology for security, democracy, foreign policy, and rights. In an effort to foster dialogue between the technology and policymaking communities, Just Security, in partnership with the University of Oxford’s Blavatnik School of Government, will launch AIET with a high-level speaker series bringing together government officials, industry leaders, and academic experts to develop critical insights for shaping a secure digital future.
Since joining Just Security in 2021, Dr. Rosen has authored numerous articles on AI, national security, counterterrorism, civilian harm, and related issues. She has advised the U.S. and U.K. governments on the global governance of AI, participated in expert meetings for the United Nations Secretary-General’s High-Level Advisory Body on Artificial Intelligence, and represented Just Security at the global summit on Responsible Artificial Intelligence in the Military Domain, held in South Korea last year.
